2. According to the prosecution case, on checking, a truck bearing registration no. JH-1AE 4313 loaded with coal was seized and on verification of the papers it was found that the truck was transporting 19,980 Kgs. coal whereas 39,795 Kgs. coal was load thereon. The petitioner is said to be driver of the truck on which coal was being transported.
3. According to the bail petition, the petitioner was merely a driver of the truck and the paper relating to the coal was prepared by the transporter.
4. Having regard to the nature of accusations and the gravity of the offence alleged, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The bail petition stands dismissed.
