JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioner seeks bail in connection with Bihiya P.S.Case No. 20 of 2017 registered for the offence under Sections 147, 148,149,307,341 and 120B of the Indian Penal Code.
Earlier prayer for bail of the petitioner was rejected vide order dated 30.08.2017 passed in Cr. Misc. No. 26805 of 2017 with observation to conclude the trial within a period of seven months and it was directed that parties shall cooperate in disposal of trial.
Submission of learned counsel for the petitioner is that he is in custody and in spite of direction, trial has not commenced.
Heard learned APP as well as learned counsel appearing on behalf of the informant. Learned counsel for the
Patna High Court Cr.Misc. No.53091 of 2018(3) dt.23-01-2019 2/2 informant has pointed out that after rejection of the bail of the petitioner and other accused persons, they have been granted provisional bail by the learned ACJM, Bhojpur at Ara and thereafter one of the accused jumped bail and has not appeared and due to that trial has not commenced.
Report of the learned ACJM-V, Bhojpur, Ara shows that case is pending for appearance of other accused in such view of the matter I am not inclined to grant bail to the petitioner. However, trial court is directed to expedite the trial of the petitioner even if by separating his case, if it requires. With this observation, this application is dismissed.
