JUSTICE SANDEEP KUMAR ORAL ORDER 14-07-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Kotwa P.S. Case No. 200/2023, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. One country made pistol has been recovered from the possession of the petitioner. Petitioner is in custody since 25.05.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation and the period

Patna High Court CR. MISC. No.42809 of 2023(2) dt.14-07-2023 2/2 of custody, this application is allowed.

Let the petitioner, above named, be released on bail after completing six months in custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-X, East Champaran, Motihari in connection with Kotwa P.S. Case No. 200/2023.
