JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2017 The petitioner seeks regular bail in connection with Aurangabad Muffasil P.S. Case No. 164 of 2016, registered for offences punishable under Sections 8/20(b)(II)(c) of NDPS Act. Allegation is of recovery of 790 kg. of ganja. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case as his name transpired in this case only on the basis of confessional statement of co-accused and except that there is nothing against the petitioner and he has no criminal antecedent and has been in judicial custody since 16.12.2016.
Learned counsel for the State opposed the prayer for bail and submitted that in this case huge quantity of ganja has been recovered and the co-accused has disclosed that it is the petitioner
Patna High Court Cr.Misc. No.35099 of 2017 (3) dt.18-09-2017 that on whose instance the alleged ganja was loaded in the vehicle. Having heard both sides, considering the fact and circumstances of the case and also that huge quantity of ganja has been recovered in this case, as such, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of nine months.
