The petitioner, who is in custody, seeks bail in connection with Pirpainty P.S. Case No. 69 of 2018 registered for the offence punishable under Sections 384, 386, 379/34 of the Indian Penal Code.
Informant has alleged that three unknown miscreants on the strength of revolver demanded Rs. 1000/- as rangdari and on refusal they snatched Rs. 24,743/- and when the informant inquired from the local people, they told name of accused persons as Pink and Nepali.
It has been submitted on behalf of the petitioner that he is not named in the FIR. During the course of investigation his name has surfaced in this case at a very belated stage. It has been further submitted that petitioner has not snatched money of the informant, rather money was snatched by two persons
Patna High Court Cr.Misc. No.53577 of 2018(3) dt.31-10-2018 2/2 namely Pink and Nepali and the motorcycle which was used to commit the crime same was recovered from the co-accused Nepali Yadav. No TIP was done. Petitioner is a Electric Mechanic and he has no criminal antecedent and is in custody since 22.06.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XI, Bhagalpur, in connection with Pirpainty P.S. Case No. 69 of 2018 subject to the conditions that:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
