Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Kudra P.S. Case No. 78 of 2021, lodged under Sections 147, 149, 341, 323, 325, 307, 504, 506 and 302 of the Indian Penal Code. As per prosecution case, fight was going on between Ramashankar Bind and Basant Bind, they reached at the house of Jagdish Bind to settle the dispute but they all started assaulting Jagdish Bind, who was injured and admitted to hospital, subsequently died in hospital during treatment, thereafter the present case has been filed.

Learned counsel for the petitioner submits that the petitioner and the informant both are neighbours. The dispute

He further submits that petitioner has been named only and only due to the reason that he is the neighbour. Learned counsel for the petitioner submits that petitioner is in custody since 06.05.2022 having clean antecedent. He also submits that the other co-accused has been granted bail by the Coordinate Bench of this Court (Annexure-4).

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVI, Kaimur (Bhabua) in connection with Kudra P.S. Case No. 78 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
