JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in connection with Rosera P.S. Case No. 174 of 2017, for offences punishable under Sections 8 of the POCSO Act and Section 354B of the Indian Penal Code.
Allegation against the petitioner is that he has molested the daughter of the informant. The petitioner is in custody since 10.07.2017 and there is statement on affidavit in paragraph-3 of the petition that the petitioner has got no criminal antecedent.
Counsel for the petitioner has submitted that the parties have entered into compromise and the informant did not want to contest the case.

No.44312 of 2017 (2) dt.21-09-2017 Considering the fact the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Children Sexual Offence Prohibition Act, Samastipur in Rosera P.S. Case No. 174 of 2017, subject to the conditions that the informant should be the bailor of the petitioner considering the statement of the petitioner that the parties have entered into compromise, the petitioner will extend full cooperation in conclusion of trial and will not tamper with the evidence or influence the witnesses.
