The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 379, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, both petitioners along with 50 unknown persons destroyed the boundary wall of the informant and when informant protested, the accused persons abused and assaulted him and also demanded Rangdari of Rs. 15 lakhs.
It is submitted that petitioners are bona fide purchasers of the land in question and only with a view to grab
Patna High Court CR. MISC. No.42330 of 2022(3) dt.06-12-2022 2/2 the land of petitioners, this false and concocted case has been lodged by the informant. Moreover, FIR has been lodged after delay of four days without any plausible explanation for the same. Petitioners claim clean antecedents.
Counsel for State vehemently opposed the prayer for bail.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 193 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
