1. The Petitioner seeks quashing of the order of nondischarge dated 09.05.2013 passed by the 6th Additional Sessions Judge, East Champaran at Motihari, in Sessions Trial No.400 of 2006.

2. Since the Petitioner seeks quashing on disputed question of facts which cannot be gone into at this stage, I am not inclined to interfere in the matter.

3. The application is dismissed.

4. The Trial Court is directed to expedite the trial without granting unnecessary adjournment to any party for which reason the Trial Court shall send a list of the witnesses fixing specific dates for their examination along with a copy of this order to the concerned Superintendent of Police, who is directed to ensure the attendance of the

Patna High Court CR. REV. No.1314 of 2013 dt.17-04-2015 2/2 witnesses on the date fixed so that there is no further delay in the trial.

5. The Trial Court should be conscious of the fact that two Sessions trial i.e. Sessions Trial No.400 of 2006 and Sessions Trial No.945 of 2006 arise out of the same transaction and, therefore, they should be tried in the same Court.
