JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Gopalpur (Rangra) P.S. Case No. 187 of 2016 instituted for the offence under Sections363, 366(A)/34 of the Indian Penal Code. It has been submitted that the victim girl has stated in her statement u/S 164 of the Cr.P.C. that she has performed marriage with this petitioner. The statement of victim girl recorded u/S 164 Cr.P.C. is annexed as Annexure-2 to this petition wherein, she has stated that she has performed marriage with this petitioner and is living with him in Delhi as husband and wife. She has also stated that physical relation has also been established between the petitioner and her (victim girl). The victim has stated her age as 18 years and the court has also assessed her age as 18 years.

Patna High Court Cr.Misc. No.37384 of 2017 (2) dt.08-08-2017 In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalpur (Rangra) P.S. Case No. 187 of 2016 to the satisfaction of learned Ist Additional Sessions Judge, Bhagalpur subject to condition that both the bailors should be close relative of the petitioner.
