In this case, the petitioner is seeking anticipatory bail in connection with Main P.S. Case No. 37 of 2018, registered for the offence punishable under Sections 363, 365 and 34 of the Indian Penal Code.
Allegation against the co-accused including the petitioner is to have kidnapped the minor girl of the informant, however, in 164 Cr.P.C. statement, the victim girl has stated that on account of facilitation by the co-accused Sunaina Devi, she started talking with the present petitioner and Sunaina Devi arranged the meeting with the present petitioner and whereafter she has gone to Ranchi where she remained with the petitioner
Patna High Court CR. MISC. No.40419 of 2019(2) dt.02-07-2019 2/2 for one and half months. She has further stated that she has love affairs with the petitioner and she has not alleged anything against the petitioner.
Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Gaya, in connection with Main P.S. Case No.37 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
