In this case, the petitioner is seeking anticipatory bail in connection with Katihar Sahayak P.S. Case No.182 of 2016, registered for the offence punishable under Sections 147, 149, 323, 342, 353, 435 and 504 of the Indian Penal Code. As per the FIR, a boy was crushed by a truck. The driver of the truck was surrounded by the people of the locality. In the meantime, the police came, intervened and while the police took him away the mob assembled and caused physical harm to the driver. The name of the petitioner has also been surfaced in the FIR.

Learned counsel for the petitioner submits that it

Patna High Court Cr.Misc. No.28582 of 2016 (2) dt.26-07-2016 2/2 was mob frenzy on account of death of the boy and there is no specific allegation against the petitioner.

Looking to the nature of allegation and the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Katihar Sahayak P.S. Case No.182 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
