JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 29-01-2016 Petitioners apprehend their arrest in a case under sections 341, 323, 307, 504/34 of the Indian Penal Code. Petitioners submit that the prosecution side and the accused side are neighbours and there is land dispute between them. Further, there is no repeated assault. I find that two petitioners are alleged to have assaulted Girish Kumar and Sanjay Rai who sustained injuries on their head. Petitioners are named in the FIR with specific allegation. In the facts of the case, the prayer for bail of the petitioners is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice.
