JUSTICE ASHUTOSH KUMAR ORAL ORDER 25-06-2019 The petitioner is aggrieved by the appointment of private respondent No. 5 on the post of Anganbari Sevika in Anganbari Centre No. 257 under Simaria Pararia Gram Panchayat in the District of Bhojpur at Arrah as also the pendency of complaint of the petitioner against such appointment before the District Programme Officer, Bhojpur at Arrah.

It has been submitted on behalf of the petitioner that despite the petitioner having obtained

Patna High Court CWJC No.12388 of 2019(2) dt.25-06-2019 2/3 higher marks in the same category than the private respondent No. 5, she has wrongly been selected as Anganbari Sevika. A regular complaint and a reminder were made by the petitioner before the District Programme Officer, Arrah on 11.02.2019 and 28.02.2019 respectively but no order has been passed by the aforesaid authority.

Under the aforesaid circumstances, the petitioner is directed to file a fresh complaint before the District Programme Officer, Bhojpur at Arrah (respondent No. 2) giving the details of the ground on which the challenge to the appointment of the private respondent No. 5 is rested, within a period of four weeks from today. The concerned respondent, on receipt of such complaint, shall provide hearing to the parties viz. the petitioner, private respondent No. 5 and other stake holders and pass a reasoned order in accordance with law within a further period of six weeks thereafter. Should the petitioner remain aggrieved by the order of

Patna High Court CWJC No.12388 of 2019(2) dt.25-06-2019 3/3 the District Programme Officer, Bhojpur at Arrah (respondent No. 2), she would have the option to challenge such order before the District Magistrate, Bhojpur at Arrah.

With the aforesaid observation/direction, the writ petition stands disposed of.
