JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-11-2022 After some argument, Sri Krishna Prasad Singh, learned senior counsel appearing on behalf of petitioner seeks permission to withdraw this anticipatory bail petition granting liberty to the petitioner to surrender before the court below and make a prayer for regular bail.

Permission is accorded. The anticipatory bail petition stands dismissed as withdrawn.

However, if petitioner surrenders before the court of learned Additional Sessions Judge-IX cum Special Judge, Excise - II, Aurangabad in Risiup P.S. Case No. 3/2022 within a period of six weeks from today and prays for regular bail, the learned court below, without being prejudiced by this order, shall examine the same on its own merit and pass appropriate order in accordance with law.
