2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 301, 302, 34/120B of the Indian Penal Code and section 27 of the Arms Act.
3. As per the prosecution case, on 8.6.2024 at about 7 pm co-villager Md. Darho caame to the house of the informant and told his father that 10 to 11 persons have come to his field to talk about his jalkar. Thereafter, informant and his father reached their field. It is alleged that 11 FIR named accused persons started assaulting father of the informant with fists and slaps and butt of country made pistol. Meanwhile, co-accused Rajesh Sahni and Dharmvir Sahni fired bullets on his father as a result of which he died on the spot.
4. Learned counsel appearing for the petitioner submits that informant is son of deceased and he claims himself to be eye witness of the occurrence. From perusal of the FIR, it is clear that all together 11 FIR named accused persons

Thereafter co-accused Rajesh Sahni and Dharmvir Sahni fired on him causing his instant death. Petitioner is neither named in the FIR nor he is alleged to have fired at the deceased. Petitioner's name has surfaced in the case during course of investigation. Petitioner claims clean antecedent.
5. Learned counsel for the State and the informant oppose the prayer for pre-arrest bail.
6. Since, petitioner is neither named in the FIR nor he is alleged to have fired bullets on the father of the deceased, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Khagaria Gangour Police Station Case No. 313 of 2024, GR No. 1760 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
