JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,448,323,324,307,379 and 436 of the Indian Penal Code.
The prosecution case is that the accused persons came and assaulted the informant and others when wife of the informant Shanti Devi, Uma Shankar Mahto, Rambha Devi came to rescue, they were also assaulted. It is further alleged that petitioner no. 3 snatched gold chain from Rambha Devi.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.54129 of 2015 (2) dt.30-11-2015 2/2 that in the background of land dispute the accusation has been levelled. The petitioners side lodged a case at earlier point of time being Sangrampur P.S. Case No. 51 of 2014. The injury has been found to be simple and co accused Dukhi Mahto has been granted anticipatory bail vide Cr. Misc. No. 46410 of 2014. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Motihari, in connection with Sangrampur P.S. Case No.54 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
