The petitioner apprehends his arrest in connection with Gardanibagh P.S. Case No. 158/2020, corresponding to G.R. No. 2015/2020 registered for the offences under Sections 25(1-b)a, 26, 35 of the Arms Act.

The name of the petitioner has surfaced on the confessional statement of co-accused, namely, Aditya Patel. The petitioner is also accused in Shashtri Nagar, P.S. Case No. 460/2015 for the offence under Section 307 of the I.P.C. and also Ram Krishna Nagar P.S. Case No. 584/2019 under Section 307 and other Sections of the I.P.C. Considering the nature of the offence and the criminal antecedent of the petitioner, in my view, this is not a fit case for grant anticipatory bail.

Patna High Court CR. MISC. No.2055 of 2021(2) dt.15-11-2021 2/2 Accordingly, this application is dismissed.

However, the petitioner is directed to surrender before the Court below within two weeks. The Superintendent of Police, Patna is directed to get the trial of Shashtri Nagar, P.S. Case No. 460/2015 and also Ram Krishna Nagar P.S. Case No. 584/2019 expedited and submit his personal affidavit by 23.12.2021 with regard to steps taken for expeditious trial of the aforesaid cases. This shall be communicated to the Superintendent of Police, Patna through fax and on the next date of hearing Sri Sajid Salim Khan, GP/SC shall assist this Court along with Sri Madan Kumar, APP.

Let a copy of this order may be handed over to Sri Sjid Salim Khan for necessary action.
