The petitioner has preferred this application for grant of regular bail in a case registered under sections 354, 341 and 34 of the Indian Penal Code and section 12 of the POCSO Act. As per the prosecution case, the two accused persons misbehaved with the informant. On raising hulla, one of them managed to escape while the petitioner was caught. It is submitted by learned counsel for the petitioner that he has been falsely implicated in the case. He was caught under a misunderstanding. The petitioner is in custody since 16.12.2020 and chargesheet has been submitted in the case. He has no criminal antecedent.

Patna High Court CR. MISC. No.52228 of 2021(2) dt.03-03-2022 2/2 taking into consideration the nature of allegation against the petitioner in the F.I.R. together with the petitioner having remained in custody for more than 1 year 2 months, the Court directs the petitioner to be enlarged on bail in connection with Special POCSO Case no.210 of 2020 (arising out of Gandhi Maidan P.S. Case no.384 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cum-Special Judge, POCSO, District Patna.
