2. After some argument, upon the specific query of the Court that whether petitioner has challenged before the appellate authority, Counsel for the petitioner submits that statutory appeal could not be moved.

3. Learned Counsel for the State has raised preliminary objection and submits that original record has been called for.

4. Upon hearing the argument, it transpires to this Court that it is necessary for the petitioner to move before the

5. In this view of the matter, the present writ petition is disposed off directing the petitioner to challenge the District order No.372/2009 passed in Departmental Proceeding No.59 of 2006 before the appellate authority within 30 days from today. Upon filing appeal, the appellate authority after receiving the original record from the Counsel for the State, who has come before this Court with original records, shall pass a reasoned and speaking order within 90 days from the date of receipt/production of a copy of this order.

6. It is made clear that the delay, if any, in filing the appeal is directed to be condoned.
