In this case, the petitioner is seeking bail in connection with Pupri P.S. Case No. 257 of 2015 registered for offences under sections 439 and 440 of the Indian Penal Code. Earlier the petitioner had moved before this Court with a prayer for bail in Cr. Misc. No. 17064 of 2016 and this Court vide order dated 25.4.2016 rejected the same with a liberty to the petitioner that if the trial is not concluded within a period of one year, he may renew his prayer for bail.
This Court has called for a report from the court below. As per report, the case of the petitioner is at the stage of framing of charge. This Court had also called for case diary. The
Patna High Court Cr.Misc. No.28050 of 2017 (3) dt.09-08-2017 statement of the different persons made in the case diary shows that the victim has committed suicide on account of the fact that her husband was very ugly whereas she was very beautiful and she was living in an incompatible manner with her husband. Looking to the facts and circumstances of the case, let the petitioner, namely, Md. Mustaque @ Guddu, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S. Case No. 257 of 2015.
