The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code and Sections 8/17 of the POCSO Act.

Allegedly, it is a case of abduction of the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the victim in her statement recorded under Section 164 of the Cr.P.C. has not named this petitioner and not whispered about the complicity of this petitioner as mentioned in the impugned order. Petitioner has clean antecedent.

Patna High Court CR. MISC. No.43299 of 2022(2) dt.09-12-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-VI-cum-Special Judge POCSO Court, Supaul in connection with Chhatapur P.S. Case No. 422 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
