The petitioner being the sister-in-law of the victiminformant is apprehending arrest in a connection with Ahiyapur P.S. Case No.981/2015 registered for the offences punishable under Sections 307 and 498A of the Indian Penal Code, pending before the learned CJM, Muzaffarpur. Subsequently, on death of the victim-informant, section 304B of the Indian Penal Code was also added.
Prosecution case is of killing the informant-victim after six years of marriage by causing burn injuries. It is alleged that the accused person poured kerosene oil on the body of the informant and, thereafter, lit the fire. Subsequently, the informant-victim succumbed to the injuries.
Patna High Court Cr.Misc. No.35285 of 2016 (3) dt.02-09-2016 2/2 It is submitted by learned counsel for the petitioner that the accusation is omnibus and general against the petitioner. Considering the specific accusation against the petitioner that she after pouring kerosene oil on the body of the informant-victim lit the fire, this Court is not inclined to grant anticipatory bail to her.
Accordingly, the prayer for anticipatory bail is rejected.
