JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special (Excise) Case No. 191 of 2019 for the offenses under Sections 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case, 7.2 ltrs of illicit foreign liquor was recovered but nothing has been recovered from the conscious possession of the petitioner. The petitioner is in custody since 25.04.2019. Considering the fact that the quantity of liquor recovered is very low, the Court is inclined to grant bail to the petitioner.
