2. The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.42595 of 2025(5) dt.24-12-2025 2/3 with Bihta P.S. Case No. 211 of 2025 registered for the offences punishable under Sections 140(3), 61, 3(5) of the BNS, 2023.
3. As per allegation, on 13.03.2025, all the FIR named accused persons including the petitioners kidnapped the informant's sister.
4. The learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. They are the persons of clean antecedents. Learned counsel has further submitted that FIR itself shows that co-accused Munna Yadav and Ghanshyam Singh took the informant's sister on motorcycle. There is nothing against these petitioners in the entire case diary. It has further been submitted that co-accused Munna Yadav has confessed his guilt and accordingly, his bail petition was rejected by a co-ordinate Bench of this Court.
5. Learned counsel for the informant as well as State opposed the prayer for anticipatory bail of the petitioners.
6. The specific allegation of kidnapping is against coaccused Munna Yadav and Ghanshyam Singh and not against these petitioners.
7. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
Patna High Court CR. MISC. No.42595 of 2025(5) dt.24-12-2025 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Danapur, Patna in connection with Bihta P.S. Case No. 211 of 2025, subject to the conditions as laid down under Section 438(2) Cr.P.C./ 482(2) of the BNSS, 2023.
