The petitioner seeks bail in Khirhar P.S.Case No.16 of 2018 / G.R.No.110/13 registered for the offences under Section 363, 366(A)/34 of the I.P.C.

Allegation against the petitioner and other accused persons is of kidnapping of minor cousin sister of the informant. Submission on behalf of the petitioner is that though he is named in the F.I.R. but victim in her statement recorded under Section 164 Cr.P.C. does not disclose the name of this petitioner and he is in custody since 11.05.2018 having no criminal antecedent. Charge sheet has been submitted.

Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and

No.52971 of 2018 (3) dt.05-10-2018 2/2 circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of the learned Munsif-cum-J.M., 1st Class, Benipatti, Madhubani, Khirhar P.S.Case No.16 of 2018 / G.R.No.110/18 subject to the condition that (1) one of the bailors must be of local person having sufficient properties within the jurisdiction of the court concerned.

(2) he shall cooperate in disposal of the trail and make himself present in the court below as and when he is required by the court below.
