The petitioners apprehend their arrest in Jhajha P.S. case No. 81 of 2016 under Section 498A, 304B, 201/34 of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The informant alleged that his sister was married to Gopal Sah of village Dario, P.S., Jhajha, district Jamui. His sister has got two sons and one daughter but from last two years her husband, father-in-law, brothers-in-law were torturing his sister due to non fulfillment of demand of dowry. The informant got information that all the six accused persons, named in the FIR, have killed his sister.
The learned counsel for the petitioners submits that petitioners No.1 and 2 are brothers-in-law of the deceased and petitioners No.3 and 4 are co-villagers of the husband of the deceased. The deceased was married with Gopal Sah about ten years
Patna High Court Cr.Misc. No.33091 of 2016 (4) dt.23-09-2016 2/2 ago. The deceased has two sons and one daughter. Her younger daughter was born in the year 2005. It is further submitted that wife of Gopal Sah was mentally ill and she fled away from the house without any information to her husband or children. It appears that petitioners are brothers and villagers of the husband of deceased. The marriage was solemnized more than 10 years ago but the deceased never made any complain regarding ill treatment at the hands of the petitioners during her lifetime.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Jamui in Jhajha P.S. Case No. 81 of 2016 (GR No. 764/16), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
