It transpired from Annexure-1(page-20) that petitioner has earlier moved before this Court and this Court vide order dated 21.01.2021 set aside the order of placement and remanded back the matter that the inquiry has been conducted in most perfunctory manner and therefore, this Court granted liberty to the respondent to start afresh from the stage of inquiry, if so advised.

Patna High Court CWJC No.16172 of 2021(3) dt.25-01-2023 2/2 Learned counsel for the petitioner submits that after passing the said order in his favour, the petitioner has filed a second show cause before the authority which is pending as yet. In this view of the matter, the present writ petition is disposed of as premature. The petitioner shall be at liberty to move after taking final decision of the Disciplinary Authority in this case.

With the aforesaid direction, this writ petition stands disposed of.
