The petitioners apprehend their arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 337, 307, 302 of the Indian Penal Code. As per the prosecution case, petitioner no. 1 assaulted mother of the informant by lathi and petitioner no. 2 assaulted on the head of the informant by lathi.

It is submitted on behalf of petitioners that both parties are co-villagers and neighbours. They were on inimical terms and due to which, they have been falsely implicated in this case. Though, there is allegation of assault against these petitioners, but there is no injury report on the record. Petitioners are not assailant of the deceased. Petitioners have got clean antecedent.

Patna High Court CR. MISC. No.42841 of 2022(3) dt.21-12-2022 2/2 However, learned counsel for the informant has opposed the bail petition and submitted that these petitioners are named in the F.I.R. and member of unlawful assembly, in which, father of the informant died.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj (Rohtas) in connection with Dinara P.S. Case No. 38 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
