Public Prosecutor.
The sole petitioner, apprehending his arrest in Giriak P.S. Case No. 116 of 2016 registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-B)A, 26, 35 of Arms Act, 1959, has prayed for grant of anticipatory bail. It was submitted by learned senior counsel for the petitioner that petitioner has falsely been made accused in the present case, due to village politics, whereas, learned Addl. Public Prosecutor opposing the prayer of petitioner submits that from the
Patna High Court Cr.Misc. No.28454 of 2016 (2) dt.28-07-2016 2/2 house of the petitioner, one carbine was recovered. He further submits that petitioner was indulged in dealing with the fire-arms. Keeping in view the nature of accusation, the Court is not inclined to extend the privilege of anticipatory bail. Dismissed.
