The petitioners seek anticipatory bail in a case instituted for the offence under Section 304(B) of the Indian Penal Code.

It is alleged in the written report that daughter of the informant namely, Munni Kumari was married on 11.6.2014 with Vijay Ram. After marriage, she was tortured in her sasural for demanding dowry and on non-fulfillment of the same, she has been killed. The police after investigation, submitted charge sheet in the case for the offence under Section 306 of the Indian Penal

Patna High Court Cr.Misc. No.30380 of 2016 (4) dt.18-01-2017 2/2 Code.

It has been submitted that the other co-accused has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 17.2.2016 passed in Cr. Misc. 482 of 2016. The petitioner No. 1 is the villager and petitioners No. 2 to 4 are Bhagina of the husband of the deceased.

The learned A.P.P. has submitted that it has come in paragraphs 2 and 5 of the case diary that the deceased was found dead by hanging.

Considering the aforesaid facts and circumstances of the case, let the petitioners in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Saraiya P.S. Case No. 128 of 2015, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Muzaffarpur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
