1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Mahila P.S. Case No. 66 of 2022 dated 28.12.2022 registered for the offences punishable under Sections 419, 420, 376 of the Indian Penal Code, Sections 4/8 of the POCSO Act and Sections 3, 4, 5, 7 and 9 of the Immoral Traffic Act.

3. The main submissions advanced by the learned counsel for the petitioner are that the instant matter relates to illicit immoral activity which was being carried on at three hotels and petitioner is stated to be Manager of one of the hotels but he had no knowledge about the alleged illicit activity and he was implicated in this case merely on account of being Manager of one of the hotels and he has fair and clean antecedent and

No.44475 of 2023(2) dt.25-07-2023 2/2 most of the co-accused persons have been granted bail by different benches of this court and against the petitioner investigation has been completed and he has been languishing in jail since 14.05.2023. Further submissions are that the statement of any of the so-called victims detailed in the FIR is not against this petitioner and alleged offence of section 376 of the IPC is not made out against him.

4. Learned APP appearing for the State opposes the bail prayer.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and the completion of investigation against him and also the fact that as per above submission most of the co-accused persons are on bail, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Mahila P.S. Case No. 66 of 2022 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) Rajiv/- U T
