JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners and counsel appearing on behalf of the State as well as Mining department. The petitioners are apprehending their arrest in connection with Barun P.S. Case No. 157 of 2018 for the offence under Sections 379/411/420/34 I.P.C. & Section 4/ 40 BMMR & 15 of Environmental Protection Act.
Learned counsel appearing on behalf of the petitioners submits that petitioners are owner and driver of Truck bearing registration No. UP 67AT-1831. Allegation against these petitioners is that they are involved in lifting of sand in illegal manner and they have failed to produce valid Challan issued by the valid contractor/lessee. In paragraph 10 of the bail
Patna High Court Cr.Misc. No.54212 of 2018(3) dt.12-12-2018 2/2 application it is stated that petitioner would produce the challan at the time of hearing of the case.
Considering the totality of the facts situation, let the petitioners above named, in the event of arrest or surrender within one moth from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 157 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C. as also subject to the condition that the petitioners shall produce the valid challan before the Court below at the time of their release.
