JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2018 The petitioners seek regular bail in connection with Ramnagar P.S. Case No. 454 of 2017, registered for offences punishable under Sections 304(B), 302/34 of the Indian Penal Code.
Petitioners happen to be father in law, mother in law and elder brother in law of the deceased and allegation against them and others is that they set the deceased on fire causing her death.
It has been submitted on behalf of the petitioners that they have falsely been made accused in this case and in fact the girl has committed suicide by setting herself on fire and in that the husband of deceased has also sustained burn injuries. Further submission is that the deceased was first treated at
Patna High Court Cr.Misc. No.53642 of 2018(3) dt.05-11-2018 2/2 Primary Health Centre and, thereafter, she was brought to Patna Medical College and Hospital and she died during course of her treatment and further there is also delay of seven days in lodging F.I.R. Further submission is that petitioners have been in judicial custody for last four months and co-accused, who is husband of the deceased has already been enlarged on bail by a coordinate Bench of this Court vide order dated 16.07.2018 passed in Cr. Misc. No. 26054 of 2018.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisinal Judicial Magistrate, Bagaha, in connection with Ramnagar P.S. Case No. 454 of 2017, subject to the condition that petitioners shall cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
