ANJANA MISHRA ORAL ORDER 19-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Bakhtiyarpur (Fatwah) G.R.P. P.S. Case No. 23 of 2015, registered for offences punishable under Sections 147, 148, 149, 2323, 353, 337, 427, 224 and 226 of the Indian Penal Code and Section 3/4 of Damage of property Act and Section 157 of Railway Act.
Learned counsel for the petitioner submits that on same and similar facts as in the present case, another case bearing R.P.F Post Fathwa P.S. Case No. 3 of 2015 has been registered against the petitioner. Learned counsel for the petitioner submits that both cases relate to the same theft of a single bag of onion but in the
Patna High Court Cr.Misc. No.48608 of 2015 (4) dt.19-01-2016 2/2 present case, the co-workers of the petitioner protested and tried to rescue the petitioner from the police which resulted in lodging of the present case.
Considering the nature of allegations made and that the petitioner is accused in a similar case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Patna Junction, Patna in connection with Bakhtiyarpur (Fatwah) G.R.P. P.S. Case No. 23 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) sunil/- U T
