The petitioner seeks bail in Special Case No. 7226/2018, arising out of Nadi Thana P.R. Case No. 93/2018, instituted for the offences under Sections 30(a), 32(i) & 38(i) of Bihar Prohibition and Excise Amendment Act, 2016. It is alleged in the written report that on secret informant that on the way of Ganga river at Sabalpur Mazar illicit liquor is being unloaded from a truck and the same is being distributed to different small vehicles, the police party reached there. Seeing the police party 15 persons managed to escape but on chase the petitioner was arrested. It is alleged that owner of the vehicles managed to run away.

Patna High Court Cr.Misc. No.55308 of 2018 (3) dt.20-09-2018 2/2 Learned counsel for the petitioner has submitted that petitioner has clean antecedent. He has been falsely implicated in this case. He is not owner of any of the vehicle. He was arrested on 04.08.2018 on suspicion and since then he is in custody. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No. 7226/2018, arising out of Nandi Thana P.R. Case No. 93/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
