1. As both the criminal miscellaneous petitions have arisen out of same P.S. case, hence they are taken up and decided together.
2. Heard Mr. D.K. Sinha, learned senior counsel for
Patna High Court CR. MISC. No.43780 of 2025(2) dt.21-07-2025 2/3 the petitioners, Mr. Rajni Ranjan Prasad Singh, learned counsel for the informant and learned APP for the State.
3. Petitioners seek regular bail in connection with Bikramganj P.S. Case No. 476 of 2024, dated 16.08.2024, registered for the offence(s) punishable under Section(s) 80, 3(5) and 123 of the B.N.S.
4. The main submissions advanced by the petitioners' counsel are that both the petitioners are father-in-law and mother-in-law of the deceased, in fact the deceased consumed poison, then she was taken to a nearby hospital by her husband for medical treatment, from where, she was referred to N.M.C.H., Jamuhar where she died during the course of medical treatment and the concerned Doctor who conducted the postmoertem examination could not have ascertained the cause of death due to which he preserved the Viscera of the deceased and sent the same for chemical examination. It is further submitted that the husband of the deceased has been granted bail by a co-ordinate Bench of this court vide order dated 06.03.2025 passed in Cr. Misc. No. 10659 of 2025 and the case of these petitioners stands on better footing from him as they are old persons and languishing in jail since 26.03.2025 and against them, investigation has been completed.

5. Learned counsel appearing for the informant as well as learned APP for the State has opposed the bail prayer of the petitioners.
6. Considering the aforesaid submissions advanced by the petitioners' counsel and mainly the facts that the deceased's husband is on bail and both the petitioners are said to be in-laws of the deceased and the prosecution has not pointed out any specific role of these petitioners in the commission of the alleged occurrence, in my opinion, it is a fit case for bail to the petitioners. Accordingly, let the petitioners named-above be enlarged on bail in connection with Bikramganj P.S. Case No. 476 of 2024, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
