JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-06-2018 The present writ petition has been filed for directing the respondents to consider the case of the petitioner for promotion on the post of Executive Engineer w.e.f. 21.11.2008. It is stated in the writ petition that firstly, the petitioner has neither been punished nor any departmental or criminal proceeding is pending against him. Secondly, it is submitted that the petitioner has been discriminated, inasmuch as the persons junior to the petitioner has been granted promotion to the post of Executive Engineer.

Patna High Court CWJC No.16156 of 2010 (3) dt.19-06-2018 2/2 Though the writ petition was filed in the year 2010 but as on date, it is not clear as to whether the petitioner has already been granted promotion or not.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of with a direction to the respondent no. 3 to consider the case of promotion of the petitioner to the post of Executive Engineer w.e.f. 21.11.2008, in case the same has not been considered, within a period of six weeks from today and pass a final order regarding the same. The writ petition is disposed of on the aforesaid terms.

Since no body has appeared on behalf of respondents, the Registry is directed to inform respondent no. 3 with regard to the passing of the present order. (Mohit Kumar Shah, J) rinkee/- U
