The petitioner seeks bail in Sarairanjan P.S. Case No. 133 of 2017, instituted for the offence under Section(s) 272, 273, 34 of the Indian Penal Code, Sections 30(a), 38(i) and 41(i) of Bihar Prohibition and Excise Act, 2016. It is alleged in the written report that informant during patrolling duty got secret informant that on Motorcycle two persons were coming towards Raipur Pothiya with illicit liquor. It is further alleged that at about 9:55 p.m. the informant saw one Motorcycle. On seeing the Police party they tried to run away, but on chase one person apprehended and another managed to run away. The apprehended persons disclosed his name as Amish Kumar. He disclosed the name of person who
Patna High Court CR. MISC. No.40728 of 2019(2) dt.05-07-2019 2/2 fled away as Manoj Rai. It is further alleged that 1.25 litres of foreign liquor has been recovered near from the Motorcycle. Co-accused Amish Kumar told the police that aforesaid liquor was given by Ram Ekewal Sahni. He called Ram Ekewal and he has been caught on the spot. He told that he got aforesaid liquor from Ranjit Sahni (petitioner) and one Indrajeet Sahni. Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. Petitioner is in custody since 30.4.2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd cum Special Judge, Excise, Samastipur, in connection with Sarairanjan P.S. Case No. 133 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
