The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, the sister of the informant was married to the elder brother of the petitioner. It is stated that the accused persons including the petitioner herein tortured the sister of the informant and ultimately she was done to death.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He happens to be the devar (brother-in-law) of the deceased. The allegations are general and omnibus in nature. The petitioner is in custody since 30.12.2020 and chargesheet has been submitted

Patna High Court CR. MISC. No.52030 of 2021(2) dt.03-03-2022 2/2 in the case. He has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the general and omnibus allegation in the F.I.R. together with the husband of the deceased being in custody and the petitioner having remained in custody for more than 1 year, the Court directs the petitioner to be enlarged on bail in connection with Darpa P.S. Case no.126 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Raxaul at Motihari, East Champaran.
