Petitioner seeks bail in a case registered for the offences punishable under Sections 18(A)/18(C)/27(D)(ii)/28 of the Drug and Cosmetic Act, 1940.

Allegation against the petitioner is that he was running a medical shop without any licence for that. Though the medicines were seized but they were not sent for chemical examination to ascertain whether the seized medicines were spurious drugs. Petitioner is in custody since 07.09.2020. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like

Patna High Court CR. MISC. No.38513 of 2020(3) dt.19-03-2021 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Gaighat Police Station Case No.273 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
