The petitioner seeks bail in anticipation of her arrest in connection with Hisua P.S. Case No. 256 of 2020 instituted for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act.
It appears from the prosecution case that 34 litres of liquor was recovered from a bag which was thrown away by the motorcycle rider. The vehicle in question is said to be registered in the name of the petitioner.
Learned counsel for the petitioner has submitted that she is a house lady and had been married to one Vikash Rajbanshi. At the time of her marriage, her father had given the
Patna High Court CR. MISC. No.39180 of 2020(2) dt.04-05-2021 2/2 motorcycle as gift to his son-in-law. Precisely for this reason, the vehicle stands registered in the name of the petitioner. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail in the event of her arrest or surrender before the Court below within a period of eight weeks from the date of receipt / production of a copy of this order on furnishing bail bonds in the sum of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge -IIcum-Special Judge, Nawada, in connection with Hisua P.S. Case No. 256 of 2020, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
