The petitioner apprehends his arrest in Pirpainti P.S. Case No. 22 of 2016 registered under Sections 409 and 420 of the Indian Penal Code.
The gist of allegation is that the petitioner took advance of Rs. 5,85,000/- under different heads but the petitioner did the work of Rs. 4,96,587/- only and Rs. 1,20,691/- is lying with the petitioner. Learned counsel for the petitioner submits that the petitioner has already handed over the charge to his successor Sikandar Yadav and nothing is lying due against the petitioner. Still the petitioner is ready to deposit Rs. 1,20,691/- in the government treasury subject to the result of the case. Considering the facts aforesaid, if the petitioner
Patna High Court Cr.Misc. No.29931 of 2016 (2) dt.06-09-2016 2/2 deposits Rs. 1,20,691/- within one month in the account of the Education Department which shall be subject to the result of the case, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XI, Bhagalpur in Pirpainti P.S. No. 22/2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
