JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-06-2021 Mr. Ashok Kumar, learned counsel for the petitioners seeks permission to withdraw the application with respect to petitioner no. 2 as he has been arrested. The application with respect to petitioner 2 is dismissed as withdrawn.

The petitioner no. 1 seeks bail in anticipation of her arrest in connection with Bhagwanpur Hat P. S. Case

Patna High Court CR. MISC. No.280 of 2021(2) dt.23-06-2021 2/3 No. 100 of 2020, dated 05.05.2020, instituted for the offences under Sections 30 (a) and 41 (1) of the Bihar Prohibition and Excise Act, 2016.

The accusation against the petitioner no. 1 is of having thrown a bag containing liquor and fleeing away. The learned counsel for the petitioner has submitted that she is an unmarried female and has been made accused in this case because of some other members of her family having been made accused in this case.

Regard being had to the afore-stated facts, the petitioner no. 1, above-named, is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge cum Special Judge, Excise, Siwan, in

Patna High Court CR. MISC. No.280 of 2021(2) dt.23-06-2021 3/3 connection with Bhagwanpur Hat P. S. Case No. 100 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
