JUSTICE SUDHIR SINGH ORAL ORDER 03-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Hulasganj P.S.Case no. 39/2010 instituted under Sections 304(B), 201, 34 of the Indian Penal Code.

The allegation against the petitioner is of killing his wife for non fulfilment of additional demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been falsely implicated in the present case, which is evident from paragraphs 10,11,12,13, 14 and 29 of the case diary. From perusal of para 60 of the case diary it appears that the police, after investigation, has submitted final form finding the case to be false.

Considering the materials in the case diary, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Hulasganj P.S.Case No. 39/2010, subject to the conditions as laid down u/s 438(2) Cr.P.C.
