The petitioner seeks bail in Siwan (Muffasil) P.S. Case No. 52 of 2000 registered under Section 392 of the Indian Penal Code.

As per the prosecution case, three unknown motorcycle born criminals looted the motorcycle of the informant on the point of pistol and the petitioner abandoned the motorcycle seeing the police force.

It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor he was apprehended on the spot. No incriminating article has been recovered from his conscious physical possession rather the said motorcycle was recovered on the road. It is also submitted that

The petitioner has been languishing in custody since 19.08.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Siwan in connection with Siwan (Muffasil) P.S. Case No.52 of 2000.
