The petitioner seeks bail in Aurai P.S. Case No. 162/2018, instituted for the offences under Sections 272 and 273 of the Indian Penal Code read with Section 30(A) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that petitioner has clean antecedent. There is no recovery of foreign liquor from personal possession of this petitioner. Seizure-list is part of F.I.R. It is mentioned in the seizure-list that aforesaid liquor has been seized from a Bathan situated towards east of the house of this petitioner.

The petitioner is in custody since 28.07.2018.

Patna High Court Cr.Misc. No.53180 of 2018 (3) dt.26-09-2018 2/2 Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur in connection with Aurai P.S. Case No. 162/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
