The petitioner seeks regular bail in connection with Kesaria P.S. Case No. 149 of 2019 registered for the offences punishable under Section 395 of the Indian Penal Code.

The allegation is regarding the unknown accused persons having apprehended the informant and snatched money from him.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and there is no evidence whatsoever so as to connect the petitioner with the alleged crime. Even upon perusal of the case dairy, it would be

No.39699 of 2019(3) dt.17-08-2019 2/2 apparent that at best the petitioner can be said to be a person who had informed the main accused person about the moment of the informant. It is submitted that though the petitioner is an accused in three other cases but the petitioner was implicated in the said cases after 24.10.2017, the date on which the petitioner was first made accused in Mehasi P.S. Case No. 320 of 2017. It is further submitted that the petitioner is on bail in the said three cases. Lastly, it is submitted that the petitioner is languishing in custody since 25.04.2019.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- 3rd, East Champaran at Motihari in connection with Kesaria P.S.
