1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned APP for the State, Mr. Chandra Bhushan Prasad, at the outset, submits that the present quashing application has been filed seeking quashing of the FIR on the ground that for the same occurrence two FIRs have been instituted. It is further submitted that from perusal of the pleadings made in the quashing application and the annexures annexed with it, it would manifest that the second FIR is not on record, as such it appears that for some ulterior reason the FIR was concealed or else when a relief is being sought on a particular issue in that event for proving that issue in the Court, the second FIR was a relevant document.

3. Considering the submission made by the learned

Patna High Court CR. MISC. No.53164 of 2021(2) dt.01-02-2024 2/2 APP for the State, the Court is not inclined to entertain the quashing application, however, gives liberty to the petitioner to file fresh application with proper pleadings and relevant documents.

4. Accordingly, the present quashing application stands rejected.
