JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-10-2018 Pursuant to the order dated 10.10.2018 the District Programme Officer (Establishment), Nalanda and District Education Officer, Nalanda are present in Court. The District Education Officer, Nalanda has explained that he has recently joined and the matter with regard to implementation of the decision of the District Teachers Appointment Appellate Authority, Nalanda is directly connected with the District Programme Officer (Establishment), Nalanda and he has no direct concern. The District Programme Officer (Establishment), Nalanda, who is present before the Court, submits that he has joined the post one year back. He admits
Patna High Court CWJC No.13601 of 2011(5) dt.29-10-2018 2/2 that till date no action was taken to take the decision of the Appellate Authority to its logical end. He has assured the Court that he will do the needful at the earliest.
Considering the assurance given to this Court the writ application is disposed of with the direction to the District Programme Officer (Establishment), Nalanda, who is present in Court, to take a decision with regard to implementation of the direction of the District Teachers Appointment Appellate Authority within 15 days from the date of receipt/production of a copy of this order. In the event there is any delay in the matter of implementation of the decision, the District Programme Officer (Establishment), Nalanda shall not draw his salary until the order of the Appellate Authority is implemented to its true letter and spirit.
Personal appearance of the officers present today is dispensed with.
With the aforesaid, the writ petition stands disposed of.
